Introduction

Soulera Private Limited (hereinafter referred to as "We," "Us," or "Our"), operating under the name Soulera, owns and manages the platform ("Platform") that provides handwriting and signature analysis services. These services aim to deliver insights into personality traits and potential areas for improvement through personalized online sessions with experts.

These Terms govern your access and use of the Platform and outline the rights and obligations between you (the “User”) and Soulera. By using the Platform, you agree to these Terms. If you disagree, you must not use the Platform.

Acceptance of Terms

By accessing or using the Platform, you confirm that you have read, understood and agreed to these Terms, our Privacy Policy and any additional terms incorporated by reference.

We will notify you of material changes to these terms through your registered email address or via a prominent notice on the Platform.
Your continued use of the Platform after any updates to these Terms signifies your acceptance of the revised Terms.
On occasion, we may organise or conduct any special promotions ("Promotions") on the Platform, such Promotions shall be governed by the Terms and any supplementary terms of use specifically determined for these Promotions.
You are advised to regularly review these Terms to remain informed about changes.

Eligibility

By accessing or using the Platform, you confirm that you have the legal capacity to agree to these Terms and to our Privacy Policy. If you are a minor (i.e. below the age of legal majority in your jurisdiction), your use of the Platform constitutes confirmation that your parent or legal guardian is fully aware of, and consents to, your provision of data and participation in handwriting and signature analysis services.

Important: Any misrepresentation of your capacity or unlawful use may result in suspension or termination of your account and forfeiture of services.

Children’s Consent

Use of Soulera by any Minor is deemed to be made with the full knowledge and approval of that Minor’s parent or legal guardian. By allowing a Minor to access the Platform, the parent or guardian confirms they are aware that handwriting and signature analysis will be performed and consent to all related data collection, processing, and storage.

Services Offered

Our Platform offers the following services:

Handwriting Analysis: Comprehensive assessment of handwriting samples to identify personality traits and areas of improvement.
Signature Analysis: Focused analysis of signatures to uncover behavioural patterns and personality insights.

Session Structure:

Introduction: The experts introduce themselves and explain the session objectives.
Purpose: Users share reasons for seeking analysis (e.g., personal development, decision-making or career insights).
Graphology Overview: The expert explains the connection between handwriting and brain activity.
Sample Analysis: The expert evaluates handwriting/signature samples submitted by the user.
Q&A: Users can ask questions and clarify findings.
Recommendations (Optional): Experts may provide actionable suggestions, exercises or remedies.
Summary: The expert concludes with key findings and potential implications for the user.

How to Access Our Services:

After successfully enrolling on the Platform, follow these steps to access our services:

Upload a Sample: Submit a sample of your handwriting or signature for analysis.
Select a Time Slot: Choose a preferred time slot for your meeting.
Make a Payment: Complete the payment process for the selected service.
Service Confirmation: Once payment is completed, your appointment with the expert will be confirmed. All scheduled appointment details will be sent to your registered email and contact number.

We reserve the right, at our sole discretion, to remove or disable any content, comment or review what you post if you fail to comply with these Terms, engage in activities that harm the Platform's goodwill, business or operations, infringe on third-party rights, violate applicable laws or for any other reason we deem appropriate.

You warrant that all information you provide to the Platform will be accurate and truthful. Please note that we may share this information with third parties who assist in providing, improving, protecting and promoting the Platform. For details on how we safeguard your data, refer to our Privacy Policy. By using the Platform, you expressly consent to the sharing of your information with such third parties.

Pricing and Payment

20-minute Signature Analysis: ₹1900 (inclusive of all taxes).
35-minute Handwriting Analysis (including Signature Analysis): ₹3700 (inclusive of all taxes).

Note: Soulera reserves the right to revise prices for its services. Any changes will apply to services not yet booked or availed.

Refunds and Cancellations Policy

• Refund Policy:

Payments are non-refundable except in the following cases:
1. Technical issues originating from the Platform prevent the delivery of the service.
2. Partial refunds may apply if sessions are interrupted due to unforeseen circumstances.
Refunds, if applicable, will be processed within 7-10 business days from the approval of the request.

• Cancellation and Rescheduling:

Users must request rescheduling at least 24 hours before the session.
Rescheduling is subject to expert availability. If an expert is unavailable for the new time slot, users will be notified and provided with alternative options.

Intellectual Property Rights

Users retain ownership of handwriting and signature samples uploaded to the Platform.
By submitting content, users grant us a non-exclusive, royalty-free license to process these samples for analysis purposes only.
We will not share or use these samples for any purpose other than delivering the agreed services.

The insights, assessments, and recommendations provided during handwriting and signature analysis sessions on the Soulera platform are intended solely for informational and guidance purposes. These services are designed to offer users personal insights into their personality traits, behavioural patterns and areas of potential improvement. However, users should be aware of the following important disclaimers:

Not a Substitute for Professional Advice:
- The opinions and guidance provided during sessions are not substitutes for professional medical, psychological, legal, financial or career-related advice.
- Users are strongly encouraged to seek advice from qualified professionals in these fields before making decisions based on the analysis provided during sessions.
Subjectivity of Analysis:
- Handwriting and signature analysis, as provided on the platform, is a subjective practice rooted in graphology.
- The interpretations and recommendations may vary depending on the expert’s perspective.
- Results should not be considered definitive or universally applicable.
No Guarantees of Outcomes:
- The recommendations are based on the user’s inputs and handwriting/signature samples at the time of analysis. Soulera and its experts do not guarantee specific outcomes or success following the implementation of the provided suggestions.
Personal Responsibility:
- Users are responsible for their own decisions and actions taken based on the insights received. Soulera is not liable for any direct or indirect consequences resulting from the use or interpretation of the analysis provided.
Scope of Services:
- The analysis focuses on personal development and self-awareness. It does not extend to diagnosing mental health conditions, predicting future events or making life-altering decisions on behalf of users.
Complementary Guidance Only:
- The insights shared during sessions should be viewed as complementary to and not a replacement for, other methods of self-assessment or professional evaluations.

By participating in handwriting or signature analysis sessions on the Soulera platform, users acknowledge and accept the above disclaimers. For any specific concerns or questions about the applicability of the analysis to their individual circumstances, users should consult a qualified professional.

User Conduct

By using our Platform, you agree to comply with these Terms, rules and regulations. Failure to adhere may result in actions including, but not limited to, suspension or termination of access, deletion of files and denial of services.

You agree to:

Receive emails or SMSs from us (e.g., mark us as “safe senders”). We are not responsible for unread communications in spam folders.
Use the Platform solely for accessing services or performing legitimate transactions. Unauthorised or commercial use is prohibited.

Prohibited activities include:

Using cheats, bots or unauthorised software to interfere with the Platform.
Copying, modifying, reverse-engineering or exploiting Platform technology without permission.
Disrupting or overloading servers or other users’ experiences.
Gaining unauthorised access to networks, servers or systems.
Posting or sharing any harmful, illegal, defamatory, offensive or inappropriate content, including viruses, unsolicited advertisements or material that infringes on intellectual property or privacy rights.
Engaging in harassment, fraud or any conduct violating applicable laws.
Encouraging or promoting criminal, harmful or unlawful activities.
Collecting personal data or interfering with others’ use of the Platform.

By using the Platform, you confirm you have capacity to agree to these Terms; if you are a Minor, your parent or guardian has consented as described above. Misuse of the Platform may result in the forfeiture of any benefits or rewards.

We reserve the right to take action against any activity deemed harmful to our Platform, users or operations at our sole discretion.

Platform and Third-Party Interactions

The Platform, along with all its content—including but not limited to software, images, text, graphics, illustrations, logos, trademarks, service marks, copyrights, photographs, audio, videos, layouts and designs (collectively referred to as “Platform Content”)—is owned by or licensed to Soulera Private Limited (operating as Soulera). All intellectual property rights associated with the Platform Content remain solely with Soulera or its licensors.

By using the Platform, you are granted a limited, non-exclusive, personal and revocable license to access and use the Platform Content for lawful, individual, and non-commercial purposes. This license strictly prohibits:

Modifying, reproducing, distributing, transmitting, publicly displaying or creating derivative works from the Platform Content.
Using the Platform Content for any commercial purposes or exploiting it in any manner without our prior written consent.

Soulera reserves the right to revoke this license at any time if there is a breach of these Terms or any other reason deemed necessary.

Third-Party Content and Interactions

The Platform may contain content created by third parties or links to third-party websites and services. While we provide these links for your convenience, we do not control, endorse, or assume responsibility for the content or policies of such third-party sites or services.

Transactions or Interactions:

Any transactions, correspondence or dealings between you and third-party providers (e.g., advertisers, payment processors or service vendors) are strictly between you and the respective third party. Soulera shall not be held liable for any loss, damages or disputes arising from such interactions.

For issues regarding third-party products or services, you are advised to contact the third party directly.

Disclaimers and Risks Associated with Platform Content

The content available on the Platform is provided for informational purposes only and should not be relied upon as professional advice. Users are encouraged to seek independent advice before making decisions based on Platform Content.

Soulera makes no guarantees, express or implied, about the accuracy, reliability or completeness of the Platform Content. Additionally, any third-party content available on the Platform is provided "as is" and we disclaim any responsibility for its accuracy, quality or reliability. You use such content at your own risk.

Revenue and Use of Platform Content

Soulera may generate revenue or goodwill through your use of the Platform, including through advertisements, sponsorships or partnerships. By using the Platform, you agree that you have no right or entitlement to share in such revenue, goodwill or benefits unless explicitly stated in a separate written agreement.

Grievance Mechanism & Security Breach Protocol

For any complaints or concerns, users can email support@soulera.in.

Complaints will be acknowledged within 48 hours and resolved within 15 business days.

In the event of a security breach:

Users will be notified within 72 hours of detection.
Immediate measures will be taken to secure user accounts and investigate the breach.

Force Majeure

We are not liable for delays or failure to fulfil our obligations under these Terms due to events beyond our reasonable control. Such events include, but are not limited to:

Natural Disasters: Acts of God, floods, earthquakes or other natural calamities.
Government Actions: Changes in law, regulations, import/export restrictions, quarantine measures or parliamentary restrictions.
Civil Unrest: War, riots, strikes or other forms of civil disturbance.
Pandemics and Epidemics: Outbreaks of diseases that impact normal operations.
Technical Failures: Interruptions caused by power outages, cyberattacks, failures of telecommunication or hosting services or other technological disruptions.

In any such case, our obligations will be suspended for the duration of the event and we will take reasonable steps to resume operations as soon as practicable. However, we will not be responsible for any direct or indirect loss or damage caused by such events.

Indemnity

You agree to defend, indemnify and hold harmless Soulera Private Limited (operating as Soulera), its affiliates, officers, employees, agents and advisors from and against any claims, damages, liabilities, costs and expenses, including attorneys' fees, arising from:

Breach of Terms: Any violation of these Terms or applicable laws by you.
Intellectual Property Violations: Uploading or sharing content that infringes on third-party intellectual property rights.
Unauthorised Activities: Use of the Platform for activities that are illegal, fraudulent or in violation of these Terms.

This indemnification includes but is not limited to, losses arising from your misuse of the Platform, disputes with third parties resulting from your actions or harm caused by the content you upload or share.

Exclusion of Warranties

The Platform and its features, services and content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

Performance Guarantees:
- That the Platform will be uninterrupted, secure or error-free.
- Those defects will be corrected promptly.
Content Accuracy:
- We do not guarantee the accuracy, reliability or completeness of any content available on the Platform, including content provided by third parties.
Third-Party Endorsements:
- We do not represent, recommend or endorse any third-party products, advertisements or services displayed on the Platform.

Furthermore, we are not responsible for:

Losses resulting from server downtime, maintenance or technological failures beyond our control.
Damage to your device or data caused by downloading or interacting with Platform content.
Any expenses incurred by you in using the Platform.

By using the Platform, you accept these risks and agree that you are solely responsible for your reliance on any information or content available on the Platform.

Limitation of Liability

To the extent permitted by law, Soulera and its affiliates will not be liable for:

Loss of profit, goodwill, data or opportunity.
Indirect, special or consequential damages arising from your use of the Platform.
Limitation of Liability for Minors: Soulera shall not be liable for any outcomes or interpretations resulting from handwriting or signature analysis conducted on Minors. Responsibility for consenting to and overseeing a Minor’s use of the Platform lies exclusively with the parent or legal guardian.
Issues caused by:
1. Third-party interactions, including advertisements and transactions.
2. Changes, interruptions or termination of Platform services.
3. Errors in content or communications transmitted through the Platform.

You are responsible for ensuring your device and internet meet the requirements for accessing the Platform. Mobile charges or data costs incurred are your responsibility.

Breach and Consequences

If you breach these Terms or misuse the Platform, we reserve the right to take appropriate actions, including:

Restricting or suspending your access to the Platform.
Terminating your account permanently.
Seeking damages or initiating legal proceedings for violations.

Our decisions regarding such breaches are final and binding and do not prejudice any additional legal remedies available to us.

Applicable Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996, with the venue being Surat, Gujarat, India. The arbitration will be conducted by a sole arbitrator mutually agreed upon by both parties. The decision of the arbitrator shall be final and binding.

Miscellaneous

Cross-Border Use: If you access the Platform from outside India, you are responsible for compliance with local laws. Soulera does not guarantee compliance with regulations in your region.
Marketing Communications: By using this platform, you agree to receive promotional emails from us. You can opt-out by updating your preferences in your account settings.
Severability: If any court of competent jurisdiction determines that any provision of these Terms is invalid or unenforceable, that provision shall be deemed severed from these Terms. The remaining provisions shall continue in full force and effect without being affected or impaired in any way.
Third-Party Links and Services: We are not responsible for the content, accuracy or reliability of third-party websites or services accessed through the Platform.
Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between users and Soulera, superseding all prior agreements or communications.
Grievance Submission: Users may submit complaints or report issues related to the Platform by emailing support@soulera.in. The complaint must include the following details:
- (a) The username or account identifier.
- (b) A description of the specific content or issue of concern.
- (c) The reasons for requesting resolution or a takedown.
Incomplete complaints may result in delays in processing.
